Introduction
These Terms and Conditions (“Terms and Conditions”) govern your purchase, access to, and participation in: (i) our fine jewelry, precious metals and stones, and other goods sold in-store or online (“Products”); (ii) our websites, platforms, applications, software, mobile apps, and related infrastructure (“Platforms”); (iii) services relating to the Products and incidental consumer-facing activities (“Services”); (iv) interactions with third parties arising from your exposure to our Platforms or activities directly involving us; and (v) any other setting in which Jewelluxuries provides Products, Platforms, or Services (collectively, the “Offerings”).
These Terms form a legally binding agreement between you and Jewelluxuries (including subsidiaries and affiliates). By clicking “Accept,” checking an acceptance box, accessing the Offerings, or providing information covered by these Terms, you acknowledge that you have read, understood, and agree to be bound by them. Do not access the Offerings if you do not agree. Section 12 applies specifically to orders placed through the Platforms and other non-Product interfaces.
Right to Update. We may modify these Terms at any time in our sole discretion. Changes are effective when posted. Continued use of the Offerings means you accept the updated Terms. Check this page periodically.
Conflicts / Incorporation. Capitalized terms not defined here have the meaning given in our other policies and agreements. Where a conflict exists: (i) a conflicting “Additional Terms” in a paid, executed agreement (e.g., warranty/repair) controls for the expressly identified Products/Services; and (ii) to the extent of direct conflict with privacy terms, the Privacy Notice/Cookie Policy controls; all non-conflicting provisions (including arbitration, waiver, indemnity, and limitation of liability) remain in effect to the fullest extent permitted by law. See FAQs for returns, shipping, and order management. Unless otherwise stated, our return policy applies to Product purchases.
Adyen Requirement — Brief Description. Jewelluxuries sells fine jewelry and related services; payments may be processed by Adyen and other payment processors listed below.
1) Overview
The Platforms let you purchase Products/Services, submit required information, and explore our Offerings. Except where a separate contract (e.g., warranty) states otherwise, we may limit, change, suspend, or discontinue any non-Product Offering without notice or liability.
2) Eligibility
Offerings are intended for users 18+ (or the age of majority in your jurisdiction). Users 13–17 may use non-Product Offerings only with parental/guardian consent. Do not provide Personal Data or access our Platforms if you are under the applicable age threshold.
3) Account / Profile
You may need an account (“Account”). Provide complete, accurate, and current information (e.g., name, email, phone, payment method, password) and keep it updated. We may suspend/terminate for inaccurate data or misuse, exceedance of use rights, or improper purposes. You are responsible for all activities under your Account, including by third parties you authorize. All entities associated with an Account are responsible for all fees incurred. 4) Payment Method
Fees are billed to your provided payment method (“Payment Method”). You authorize charges for taxes, shipping, handling, and other amounts. Keep billing details current; if a charge is declined, you agree to provide a new Payment Method and pay collection costs (including attorneys’ fees). We may use third-party payment processors (currently Adyen, Apple Pay, Klarna, PayPal; subject to change). You may have to accept their terms and pass their vetting. We are not a party to those agreements and are not liable for them. You authorize final charges upon fulfillment, including adjustments from deposits/reservations. See FAQs for details.
5) Intellectual Property; User Content
IP. The Platforms, their design, and all associated materials are owned/controlled/licensed by Jewelluxuries or our licensors and are protected by law (“Protected IP”). Except as expressly granted in a separate written agreement, you acquire no rights in the Protected IP and you will not use, alter, imitate, or create confusingly similar marks, logos, trade dress, or colors suggesting endorsement. Third-party marks are property of their owners; any rights we have are non-exclusive, worldwide, royalty-free licenses for use within the Offerings.
User Content. See our User-Generated Content Policy. You irrevocably waive any moral rights and warrant you own or are authorized to grant the rights you submit. You waive claims against us related to copyright, privacy, or publicity arising from User Content.
6) Restricted Use
You must not: (a) misuse the Offerings; (b) violate law, third-party rights, or these Terms; (c) interfere with security or integrity; (d) reverse engineer, scrape, or harvest data except as permitted by law; (e) bypass access controls; (f) use our IP to imply sponsorship/endorsement.
7) Third-Party Sites, Links, Vendors
Links may lead to sites/services beyond our control. We neither endorse nor control their content, availability, legality, or security. You assume all risk when accessing third-party content and must protect your systems. Some Offerings require third-party “Application Processors.” You may need to accept their terms and pass vetting; we are not a party and bear no liability. Address disputes with the applicable third party.
8) Disclaimers
Pricing, promotions, and availability vary by location/site; errors (descriptions/typographical/photographic) are subject to correction. Except as expressly stated, the Offerings are provided “AS IS” and “WITH ALL FAULTS.” We disclaim all warranties (express/implied/statutory), including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation or freedom from harmful components. Your use is at your own risk; information is general and not a substitute for professional advice or independent investigation.
9) Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless Jewelluxuries and our affiliates, officers, employees, agents, licensors, and providers from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from: (a) information or content you submit; (b) your participation in or exposure to the Offerings; (c) your breach of these Terms; (d) your infringement/misappropriation of IP or other rights; (e) unlawful or offensive content you post; (f) injury or harm connected to the Offerings; or (g) Products/Offerings you sell/purchase/participate in.
10) Limitation of Liability; Arbitration
To the fullest extent permitted by law, Jewelluxuries and related parties are not liable for any direct/indirect, incidental, special, consequential, punitive, or exemplary damages, lost profits, personal injury, property damage, or other losses arising from or related to your use/inability to use the Offerings. In no event will aggregate liability exceed the purchase price of the related Product/Service; where permitted by law, liability may be further limited to $1.00 USD or the smallest amount allowed by jurisdiction. Force majeure applies.
Arbitration / Venue. Except where prohibited, disputes are resolved individually by binding arbitration administered by a recognized arbitration body under its commercial rules in Denver, Colorado, governed by Colorado law (without conflict-of-laws), with limited discovery and timelines. No class or representative actions. The arbitrator may not award punitive or non-actual damages except as required by statute. Judgment may be entered in any court of competent jurisdiction. Confidentiality applies unless disclosure is legally required.
11) General Provisions
Survival. Provisions that by nature should survive termination do so.
Governing Law. Colorado and U.S. law govern, without regard to conflicts of law.
Severability. Unenforceable terms are reformed to the minimum extent; the remainder stays in effect.
Entire Agreement. These Terms are the entire agreement concerning the Offerings, supplemented by any applicable Additional Terms.
Equitable Relief. Breach may cause irreparable harm; equitable remedies (injunction) are available.
No Agency. No partnership, employment, agency, joint venture, or franchise is created.
Waiver. Failure to enforce is not a continuing waiver; waivers must be in writing and are narrow.
No Third-Party Beneficiaries. Unless expressly stated, none.
Updates. We may revise Terms/FAQs in our discretion; effective upon posting.
12) Purchases and Orders via the Offerings
Pricing & Availability. Prices shown in USD unless stated otherwise; taxes/shipping/handling extra. We may impose quantity limits, reject/cancel orders, or discontinue Services even after order placement (subject to any separate service contract). Taxes may be adjusted. Site/store prices may differ.
Stock. Online availability isn’t guaranteed. We’ll notify you if an item is unavailable after processing. Displayed colors may vary by device.
Errors. We may correct errors and revise or cancel orders (with refund if applicable). Your sole remedy is cancellation and refund.
Electronic Transactions. Transactions may be conducted electronically and calls may be recorded. Keep copies of agreements and disclosures.
Access Termination. We may suspend/deny/terminate access at any time without prior notice or liability.
13) Content Uploader — DMCA
We respect IP rights and follow the DMCA safe harbor.
Notices of Claimed Infringement must include: (a) description of the copyrighted work; (b) URL/location of allegedly infringing material; (c) signature of the rightsholder/agent; (d) good-faith statement; (e) accuracy statement under penalty of perjury; (f) your name, postal address, phone, and email. Send to [[email protected]].
Counter-Notice must identify the removed material and location before removal; include consent to jurisdiction (or as otherwise governed by the arbitration clause), acceptance of service, contact details, a good-faith statement under penalty of perjury, and your signature. If valid, we may restore material in 10–14 business days unless the complaining party files an action.
Repeat Infringers. We may disable/terminate access after multiple adjudicated infringements.
Warranties. You warrant uploaded content does not violate third-party IP, privacy, or publicity rights and is your original work or you hold necessary permissions.
